Mediation is quicker than any legal route. Government figures show that mediation outcomes take an average of 110 days. Non-mediation outcomes take an average of 435 days. As a consequence, it should come as no surprise that the average mediated outcome costs are around only 6% of those of a dispute resolved through the courts. (View letter here.)
Many mediators offer fixed prices for preparation, mediation meetings and follow-up work. This offers good value and certainty for clients. These costs tend to be shared by the clients.
Whereas appointments in court are fixed to the court’s convenience, mediation meetings can be arranged for a time which is convenient for all involved, including weekends to fit in with busy work schedules and other commitments.
The mediation process is managed by one person, the mediator, rather than two, as when lawyers are engaged.. This helps the process run smoothly, efficiently and more quickly which keeps costs down.
Outcomes reached in mediation are longer lasting than decisions imposed by a court. This is because decisions made in mediation are made by the participants themselves. Court orders may not be what either of the people involved wanted or hoped for. This can mean that the order isn’t followed and that those involved end up back in court facing more stress, upset and cost.

Legal aid is rarely available for making court applications. It is usually restricted to cases where there is a child protection issue.
